Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zen Pregnancy mobile application (also listed on the App Store as "Hypnobirthing Pregnancy"), its widgets and Apple Watch app, family pages, and the website at zenpregnancy.net (together, the "Service"), operated by Zen Pregnancy ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have parental or legal guardian consent. By using the Service, you represent that you meet these requirements.

2. No Account Required

The Service does not require an account, email address, or password. Your app data is stored on your device. You are responsible for keeping your device secure and for keeping your private family page link and join code safe. Anyone who has them can view your family page, and anyone with your join code can post to it.

3. The Service

Zen Pregnancy provides guided pregnancy meditations, hypnobirthing audio sessions, a daily program, breathing exercises, birth affirmations, a contraction timer, a baby kick counter, a weight tracker, a journal, home screen widgets, an Apple Watch app, and Live Family Sharing. Some content is free. Premium content and features are available through a paid subscription or one-time purchase.

4. Medical Disclaimer

The Service is not medical advice. Zen Pregnancy provides relaxation, meditation, and breathing tools for pregnancy wellness and birth preparation. It is not a substitute for professional medical care, diagnosis, or treatment.

Always consult your OB-GYN, midwife, or qualified healthcare provider before making decisions about your pregnancy, labor, or postpartum care. Do not disregard professional medical advice or delay seeking it because of information or content provided through the Service.

Hypnobirthing and meditation techniques may support relaxation and coping during labor, but they do not guarantee specific birth outcomes, including pain-free labor, shorter labor duration, or avoidance of medical interventions. Individual results vary.

If you experience a medical emergency, call 911 (US) or your local emergency number immediately.

5. Subscriptions and Payments

Premium features are available through auto-renewing subscriptions or a one-time lifetime purchase via the Apple App Store (or Google Play, where available). Price, billing period, and any free trial are shown before you confirm a purchase.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• You can manage or cancel your subscription anytime in your App Store account settings. Cancellation takes effect at the end of the current billing period.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple (or Google) under their policies. We cannot issue refunds for app store purchases directly.

You can restore past purchases on a new device using "Restore Purchases" in the app.

6. Intellectual Property

All content in the Service — including audio recordings, text, graphics, logos, design, and software — is owned by or licensed to Zen Pregnancy and is protected by copyright, trademark, and other intellectual property laws.

You may use the Service for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Service without our prior written permission.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Share, redistribute, or resell audio content or other premium materials
• Attempt to reverse-engineer, decompile, or access the source code of the app
• Interfere with or disrupt the Service or its servers, or try to guess or access family pages that were not shared with you
• Impersonate any person or entity
• Use automated tools to scrape, harvest, or collect content from the Service

8. Live Family Sharing

Live Family Sharing is an optional feature that lets you create a private family page and share pregnancy updates, photos, labor updates, and a birth announcement with people you choose.

• Private links. Your family page is available to anyone who has its link. You decide who receives the link. Your partner can join with a join code, which lets them post and time contractions on the same page.
• Your content. You keep ownership of the photos and text you post ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content only to operate your family page for the people you share it with. This license ends when your content is deleted.
• Your responsibility. You confirm that you have the right to share Your Content, including permission from adults who appear in your photos. You are responsible for content posted on your page by you and your partner.
• Not allowed. Do not post content that is illegal, sexually explicit, hateful, harassing, violent, infringing, or that exposes another person's private information without consent. Family members who comment must follow the same rules.
• Moderation. You can delete any post and hide any comment at any time. We may remove content or disable a family page that violates these Terms or the law, or that is reported to us.
• Temporary by design. You can delete your entire family page at any time from the app. Every family page, with all of its photos and updates, is automatically and permanently deleted 60 days after the due date (or after 60 days without activity if no due date is set). Deleted content cannot be recovered, so save anything you want to keep before then.
• Not an emergency service. Family updates and labor timing may be delayed or unavailable because of connectivity or server issues. Never rely on Live Family Sharing to call for help. In an emergency, call your local emergency number.

9. Third-Party Links

The Service may contain links to third-party websites, apps, or resources. We are not responsible for the content, accuracy, or practices of third-party sites. Accessing third-party links is at your own risk and subject to their terms and privacy policies.

10. Limitation of Liability

To the maximum extent permitted by law, Zen Pregnancy and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to pregnancy outcomes, birth experiences, emotional distress, or reliance on content provided through the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $50, whichever is greater.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Indemnification

You agree to indemnify and hold harmless Zen Pregnancy, its owners, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including liability limitations, disclaimers, and indemnification) will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Apple App Store Terms

If you downloaded the app from the Apple App Store, these Terms are between you and Zen Pregnancy, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with Apple's Standard End User License Agreement and the App Store Terms of Service.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
